EB-3

The USA EB-3 Immigration Visa for Skilled Workers facilitates permanent residency for foreign nationals possessing specific occupational skills and backgrounds. The EB-3 program, categorized under "employment-based third preference," prioritizes applicants with job offers in the United States, focusing on skills that are in demand but not necessarily exceptional.

The program is divided into three categories:

1. Skilled Workers: Requires at least two years of experience in a skilled occupation and a permanent job offer in the US.

2. Professionals: Requires a bachelor’s degree and a job offer that necessitates the degree.

3. Other Workers: Involves unskilled labor with less than two years of experience and a job offer requiring such labor.

Employer sponsorship is mandatory under the EB-3 program, involving a Labor Certification to confirm the unavailability of qualified US workers. Once approved, an Immigrant Petition for Alien Worker is filed to seek permanent resident status for the applicant.

Compared to other employment-based immigration paths like EB-1 and EB-2, EB-3 is seen as more accessible since it does not mandate exceptional skills or a minimum investment like the EB-5 program. It attracts professionals in fields such as healthcare, education, and skilled trades where there is a shortage of qualified US workers.

The USA EB-3 Visa is a popular choice for immigrants seeking permanent residency based on employment in the United States..

Eligibility for the EB-3 Visa is assessed based on education, skills, and work experience:

Semi-skilled workers must demonstrate at least 6 months of relevant experience or training and prove their ability to perform the specific job required. Lalani & Associates offers job placements in this category, including roles such as nurses, caregivers, fast food counter attendants, window cleaners, and janitors.

Nursing and caregiving positions necessitate a diploma or bachelor’s degree in nursing (BSN), while other roles require at least intermediate or matriculation education levels. Proficiency in basic English is also required for all applicants.

Additionally, full-time permanent employment and a labor certification are mandatory. The job must be such that no qualified US workers are available to fill the position.

Key Benefits of the EB-3 Visa:

1. Eligible foreign workers can obtain green cards, enabling them to live and work permanently in the USA with their families.

2. Spouses and unmarried children under 21 years old can accompany the worker to the USA.
